Spain Issues Fine for AI-Generated Sexual Images of Minors
(Reuters) -Spain's data protection agency on Thursday said it had fined a person for sharing AI-generated sexual images of minors using real faces, in what Spanish media said was the first case in Europe of a financial penalty for this type of content. The watchdog opened an investigation in September 2023 after Spanish media reported the creation and circulation of the images in Almendralejo, a town of 30,000 people in the Spanish southwestern region of Extremadura. The person breached the EU's data protection law by using the faces of real minors in the AI-generated images and then distributing them, the Spanish Data Protection Agency said in a statement. "The offender is being punished for disseminating photographs manipulated with artificial intelligence that included the faces of real people," it said. The fine of 2,000 euros ($2,332) was reduced to 1,200 euros after the person admitted responsibility and paid voluntarily, the agency said. .The agency determined that the individual violated the European Union's General Data Protection Regulation (GDPR) by using the faces of real minors in AI-generated sexual images and subsequently distributing this content. This application of existing data protection law to AI-generated content demonstrates how current legal frameworks can be adapted to address emerging technological challenges.
The Spanish Data Protection Agency initially imposed a fine of €2,000 ($2,332) on the offender. However, this amount was subsequently reduced to €1,200 after the individual admitted responsibility for their actions and agreed to pay the penalty voluntarily

This landmark case represents a crucial development in the evolving landscape of AI regulation and digital rights protection. By successfully prosecuting someone under existing data protection laws for AI-generated content, Spain has demonstrated that current legal frameworks, particularly the GDPR, can be effectively applied to address new forms of digital harm enabled by artificial intelligence technologies.
The case also highlights the growing concern among European regulators about the potential for AI tools to be misused for creating non-consensual intimate imagery, particularly involving minors. As AI image generation technology becomes increasingly sophisticated and accessible, legal systems across Europe are grappling with how to prevent and punish such misuse while balancing innovation and free expression concerns.
