A Norwegian man said he was horrified to discover that ChatGPT outputs had falsely accused him of murdering his own children. According to a complaint filed Thursday by European Union digital rights advocates Noyb, Arve Hjalmar Holmen decided to see what information ChatGPT might provide if a user searched his name. He was shocked when ChatGPT responded with outputs falsely claiming that he was sentenced to 21 years in prison as "a convicted criminal who murdered two of his children and attempted to murder his third son," a Noyb press release said. ChatGPT's "made-up horror story" not only hallucinated events that never happened, but it also mixed "clearly identifiable personal data" -- such as the actual number and gender of Holmen's children and the name of his hometown -- with the "fake information," Noyb's press release said. ChatGPT hallucinating a "fake murderer and imprisonment" while including "real elements" of the Norwegian man's "personal life" allegedly violated "data accuracy" requirements of the General Data Protection Regulation (GDPR), because Holmen allegedly could not easily correct the information, as the GDPR requires. As Holmen saw it, his reputation remained on the line the longer the information was there, and -- despite "tiny" disclaimers reminding ChatGPT users to verify outputs -- there was no way to know how many people might have been exposed to the fake story and believed the information was accurate. "Some think that 'there is no smoke without fire,'" Holmen said in the press release. "The fact that someone could read this output and believe it is true, is what scares me the most." Currently, ChatGPT does not repeat these horrible false claims about Holmen in outputs. A more recent update apparently fixed the issue, as "ChatGPT now also searches the Internet for information about people, when it is asked who they are," Noyb said. But because OpenAI had previously argued that it cannot correct information -- it can only block information -- the fake child murderer story is likely still included in ChatGPT's internal data. And unless Holmen can correct it, that's a violation of the GDPR, Noyb claims. "While the damage done may be more limited if false personal data is not shared, the GDPR applies to internal data just as much as to shared data," Noyb says. OpenAI may not be able to easily delete the data Holmen isn't the only ChatGPT user who has worried that the chatbot's hallucinations might ruin lives. Months after ChatGPT launched in late 2022, an Australian mayor threatened to sue for defamation after the chatbot falsely claimed he went to prison. Around the same time, ChatGPT linked a real law professor to a fake sexual harassment scandal, The Washington Post reported. A few months later, a radio host sued OpenAI over ChatGPT outputs describing fake embezzlement charges. In some cases, OpenAI filtered the model to avoid generating harmful outputs but likely didn't delete the false information from the training data, Noyb suggested. But filtering outputs and throwing up disclaimers aren't enough to prevent reputational harm, Noyb data protection lawyer, Kleanthi Sardeli, alleged. "Adding a disclaimer that you do not comply with the law does not make the law go away," Sardeli said. "AI companies can also not just 'hide' false information from users while they internally still process false information. AI companies should stop acting as if the GDPR does not apply to them, when it clearly does. If hallucinations are not stopped, people can easily suffer reputational damage." Noyb thinks OpenAI must face pressure to try harder to prevent defamatory outputs. Filing a complaint with the Norwegian data authority Datatilsynet, Noyb is seeking an order requiring OpenAI "to delete the defamatory output and fine-tune its model to eliminate inaccurate results." Noyb also suggested imposing "an administrative fine to prevent similar violations in the future." It's Noyb's second complaint challenging OpenAI's ChatGPT, following a complaint to an Austrian data protection authority last April. Increasingly, EU member states are scrutinizing AI companies, and OpenAI has remained a popular target. In 2023, the European Data Protection Board promptly launched a ChatGPT task force investigating data privacy concerns and possible enforcement actions soon after ChatGPT began spouting falsehoods users alleged were defamatory. So far, OpenAI has faced consequences in at least one member state, where the outcome might bode well for Noyb's claims. In 2024, it was hit with a $16 million fine and temporary ban in Italy following a data breach leaking user conversations and payment information. To restore ChatGPT, OpenAI was ordered to make changes, including providing "a tool through which" users "can request and obtain the correction of their personal data if processed inaccurately in the generation of content." If Norwegian data authorities similarly find that OpenAI doesn't allow users to correct their information, OpenAI could be forced to make more changes in the EU. The company might even need to overhaul ChatGPT's algorithm. According to Noyb, if ChatGPT feeds user data like the false child murderer claim "back into the system for training purposes," then there may be "no way for the individual to be absolutely sure [that problematic outputs] can be completely erased... unless the entire AI model is retrained."

But under the European Union's General Data Protection Regulation (GDPR), Europeans have a suite of data access rights that include a right to rectification of personal data. Since then, though, it's fair to say that privacy watchdogs around Europe have adopted a more cautious approach to GenAI as they try to figure out how best to apply the GDPR to these buzzy AI tools. Two years ago, Ireland's Data Protection Commission (DPC) -- which has a lead GDPR enforcement role on a previous Noyb ChatGPT complaint -- urged against rushing to ban GenAI tools, for example. This suggests that regulators should instead take time to work out how the law applies. And it's notable that a privacy complaint against ChatGPT that's been under investigation by Poland's data protection watchdog since September 2023 still hasn't yielded a decision. Noyb's new ChatGPT complaint looks intended to shake privacy regulators awake when it comes to the dangers of hallucinating AIs. The nonprofit shared the (below) screenshot with TechCrunch, which shows an interaction with ChatGPT in which the AI responds to a question asking "who is Arve Hjalmar Holmen?" -- the name of the individual bringing the complaint -- by producing a tragic fiction that falsely states he was convicted for child murder and sentenced to 21 years in prison for slaying two of his own sons. While the defamatory claim that Hjalmar Holmen is a child murderer is entirely false, Noyb notes that ChatGPT's response does include some truths, since the individual in question does have three children. The chatbot also got the genders of his children right. And his home town is correctly named. But that just it makes it all the more bizarre and unsettling that the AI hallucinated such gruesome falsehoods on top. A spokesperson for Noyb said they were unable to determine why the chatbot produced such a specific yet false history for this individual. "We did research to make sure that this wasn't just a mix-up with another person," the spokesperson said, noting they'd looked into newspaper archives but hadn't been able to find an explanation for why the AI fabricated child slaying. Large language models such as the one underlying ChatGPT essentially do next word prediction on a vast scale, so we could speculate that datasets used to train the tool contained lots of stories of filicide that influenced the word choices in response to a query about a named man. Whatever the explanation, it's clear that such outputs are entirely unacceptable. Noyb's contention is also that they are unlawful under EU data protection rules. And while OpenAI does display a tiny disclaimer at the bottom of the screen that says "ChatGPT can make mistakes. Check important info," it says this cannot absolve the AI developer of its duty under GDPR not to produce egregious falsehoods about people in the first place. OpenAI has been contacted for a response to the complaint. While this GDPR complaint pertains to one named individual, Noyb points to other instances of ChatGPT fabricating legally compromising information -- such as the Australian major who said he was implicated in a bribery and corruption scandal or a German journalist who was falsely named as a child abuser -- saying it's clear that this isn't an isolated issue for the AI tool. One important thing to note is that, following an update to the underlying AI model powering ChatGPT, Noyb says the chatbot stopped producing the dangerous falsehoods about Hjalmar Holmen -- a change that it links to the tool now searching the internet for information about people when asked who they are (whereas previously, a blank in its data set could, presumably, have encouraged it to hallucinate such a wildly wrong response). In our own tests asking ChatGPT "who is Arve Hjalmar Holmen?" the ChatGPT initially responded with a slightly odd combo by displaying some photos of different people, apparently sourced from sites including Instagram, SoundCloud, and Discogs, alongside text that claimed it "couldn't find any information" on an individual of that name (see our screenshot below). A second attempt turned up a response that identified Arve Hjalmar Holmen as "a Norwegian musician and songwriter" whose albums include "Honky Tonk Inferno." However an earlier Noyb-backed GDPR complaint against OpenAI, which was filed in Austria in April 2024, was referred by the regulator to Ireland's DPC on account of a change made by OpenAI earlier that year to name its Irish division as the provider of the ChatGPT service to regional users. "Having received the complaint from the Austrian Supervisory Authority in September 2024, the DPC commenced the formal handling of the complaint and it is still ongoing," Risteard Byrne, assistant principal officer communications for the DPC told TechCrunch when asked for an update. He did not offer any steer on when the DPC's investigation of ChatGPT's hallucinations is expected to conclude.

OpenAI has come under fire from a European privacy rights group, which has filed a complaint against the company after its artificial intelligence (AI) chatbot falsely stated that a Norwegian man had been convicted of murdering two of his children. The man asked ChatGPT "Who is Arve Hjalmar Holmen?" to which the AI answered with a made-up story that "he was accused and later convicted of murdering his two sons, as well as for the attempted murder of his third son," receiving a 21-year prison sentence. However, not all of the details of the story were made up as the number and the gender of his children and the name of his hometown were correct. AI chatbots are known to give misleading or false responses which are called hallucinations. This can be due to the data that the AI model was trained on, such as if there are any biases or inaccuracies. The Austria-based privacy advocacy group Noyb announced its complaint against OpenAI on Thursday and showed the screenshot of the response to the Norwegian man's question to OpenAI. Noyb redacted the date that the question was asked and responded to by ChatGPT in its complaint to the Norwegian authority. However, the group said that since the incident, OpenAI has now updated its model and searches for information about people when asked who they are. For Hjalmar Holmen, this means that ChatGPT no longer says he murdered his sons. But Noyb said that the incorrect data may still be a part of the large language model (LLM) dataset and that there is no way for the Norwegian to know if the false information about him has been permanently deleted because ChatGPT feeds user data back into its system for training purposes. "Some think that 'there is no smoke without fire'. The fact that someone could read this output and believe it is true is what scares me the most," Hjalmar Holmen said in a statement. Noyb filed its complaint to the Norwegian Data Protection Authority, alleging that OpenAI violates Europe's GDPR rules, specifically Article 5 (1)(d), which obliges companies to make sure that the personal data that they process is accurate and kept up to date. Noyb has asked Norway's Datatilsynet to order OpenAI to delete the defamatory output and fine-tune its model to eliminate inaccurate results. It has also asked that an administrative fine be paid by OpenAI "to prevent similar violations in the future". "Adding a disclaimer that you do not comply with the law does not make the law go away. AI companies can also not just 'hide' false information from users while they internally still process false information," Kleanthi Sardeli, data protection lawyer at Noyb, said in a statement. "AI companies should stop acting as if the GDPR does not apply to them when it clearly does. If hallucinations are not stopped, people can easily suffer reputational damage," she added. A Norwegian man called Arve Hjalmar Holmen recently struck up a conversation with ChatGPT to see what information OpenAI's chatbot would offer when he typed in his own name. He was horrified when ChatGPT allegedly spun a yarn falsely claiming he'd killed his own sons and been sentenced to 21 years in prison (via TechCrunch). The creepiest aspect? Around the story of the made up crime, ChatGPT included some accurate, identifiable details about Holman's personal life, such as the number and gender of his children, as well as the name of his home town. The privacy rights advocacy group Noyb soon got involved. The organisation told TechCrunch they carried out their own investigation as to why ChatGPT could be outputting these claims, checking to see if perhaps someone with a similar name had committed serious crimes. Ultimately, they could not find anything substantial along these lines, so the 'why' behind ChatGPT's hair-raising output remains unclear. The chatbot's underlying AI model has since been updated, and it now no longer repeats the defamatory claims. However Noyb, having previously filed complaints on the grounds of ChatGPT outputting inaccurate information about public figures, was not satisfied to close the book here. The organisation has now filed a complaint with Datatilsynet (the Norwegian Data Protection Authority) on the grounds that ChatGPT violated GDPR. Under Article 5(1)(d) of the EU law, companies processing personal data have to ensure that it's accurate-and if it's not accurate, it must either be corrected or deleted. Noyb makes the case that, just because ChatGPT has stopped falsely accusing Holmen of being a murderer, that doesn't mean the data has been deleted. Noyb wrote, "The incorrect data may still remain part of the LLM's dataset. By default, ChatGPT feeds user data back into the system for training purposes. This means there is no way for the individual to be absolutely sure that this output can be completely erased [...] unless the entire AI model is retrained." Noyb also alleges that, by its nature, ChatGPT does not comply with Article 15 of GDPR. Simply put, there's no guarantee that you can call back whatever you feed into ChatGPT-or see whatever data about you has been fed into its dataset. On this point, Noyb shares, "This fact understandably still causes distress and fear for the complainant, [Holmen]." At present, Noyb are requesting that Datatilsynet order OpenAI to delete the inaccurate data about Holmen, and that the company ensures ChatGPT can't hallucinate another horror story about someone else. Given OpenAI's current approach is merely displaying the disclaimer "ChatGPT can make mistakes. Consider checking important information," in tiny font at the bottom of each user session, this is perhaps a tall order. Still, I'm glad to see Noyb apply legal pressure to OpenAI, especially as the US government has seemingly thrown caution to the wind and gone all in on AI with the 'Stargate' infrastructure plan. When ChatGPT can easily output defamatory claims right alongside accurate, identifying information, a crumb of caution feels like less than the bare minimum.
