AI skeptics aren't the only ones warning users not to unthinkingly trust models' outputs -- that's what the AI companies say themselves in their terms of service. Take Microsoft, which is currently focused on getting corporate customers to pay for Copilot. But it's also been getting dinged on social media over Copilot's terms of use, which appear to have been last updated on October 24, 2025. "Copilot is for entertainment purposes only," the company warned. "It can make mistakes, and it may not work as intended. Don't rely on Copilot for important advice. Use Copilot at your own risk." A Microsoft spokesperson told PCMag that the company will be updating what they described as "legacy language." "As the product has evolved, that language is no longer reflective of how Copilot is used today and will be altered with our next update," the spokesperson said. Tom's Hardware noted that Microsoft isn't the only company using this kind of disclaimer for AI. For example, both OpenAI and xAI caution users that they should not rely on their output as "the truth" (to quote xAI) or as "a sole service of truth or factual information" (OpenAI).

In recent days, the agreement has made the rounds on social media, where it's facing plenty of criticism since it seems to clash with Microsoft's marketing, which positions Copilot as a powerful and useful tool for users and businesses. "It's not a good sign when a company won't stand behind the accuracy of their product. If Microsoft doesn't trust copilot, why should I?" questioned one Reddit user. Previous versions of the terms, dating back to 2023, were more vague and said: "The Online Services are for entertainment purposes." Another user also noticed that the "entertainment purposes only" phrasing seems to match disclaimers posted on TV programs featuring ghosts or psychics to prevent lawsuits. Indeed, you can find online psychic services that mention the same, noting "readings should be viewed as being for entertainment purposes only and in no way replaces proper legal, financial or medical advice." Microsoft has already been caught in AI-related lawsuits over ChatGPT data scraping after investing billions in OpenAI. Microsoft didn't immediately respond to a request for comment. But it's clear Redmond has faced pushback over its focus on AI, with some critics calling the company "Microslop," a reference to AI slop. Perhaps in response, a Microsoft executive downplayed the company's AI focus last month while talking up major improvements to future Windows 11 updates.

Microsoft used to push its AI services towards its user base, especially with the launch of the Copilot+ PC, but it seems that even the company itself does not trust its creation. According to the Microsoft Copilot Terms of Use, which was updated in October last year, the AI large language model (LLM) is designed for entertainment use only, and users should not use it for important advice. While this may be a boilerplate disclaimer, it's quite ironic given how hard the company wants people to use Copilot for business uses and has integrated it into Windows 11. "Copilot is for entertainment purposes only. It can make mistakes, and it may not work as intended," the document said. "Don't rely on Copilot for important advice. Use Copilot at your own risk." This isn't limited to Copilot, too. Other AI LLMs have similar disclaimers. For example, xAI says "Artificial intelligence is rapidly evolving and is probabilistic in nature; therefore, it may sometimes: a) result in Output that contains "hallucinations," b) be offensive, c) not accurately reflect real people, places or facts, or d) be objectionable, inappropriate, or otherwise not suitable for your intended purpose." These may sound common sense for people familiar with how LLMs work, but, unfortunately, some people treat AI output as gospel, even those who are supposed to know better. We've seen this with Amazon's services, after some AWS outages were reportedly caused by an AI coding bot after engineers let it solve an issue without oversight. The Amazon website itself has also been hit with a few "high blast radius" incidents that were linked to "Gen-AI assisted changes," resulting in senior engineers being called up in a meeting to resolve the matter. While generative AI is a useful tool and can indeed increase productivity, it's still just a tool that offers no accountability for any mistakes that it might make. Because of this, people who use it must be careful to always doubt its output and double-check its results. But even if you're aware of the limitations of current AI technology, humans are susceptible to automation bias, wherein we tend to favor the results that machines produce and ignore data that might contradict that. AI could make this phenomenon more severe, especially as it can create results that look plausible or even true with a cursory glance. Companies in general usually add disclaimers like these to their products and services to protect themselves from lawsuits. But as AI tech companies push their AI services as the ultimate productivity hack, they might be minimizing the risks attached to the use of AI tools just to get customers paying and recoup the billions they've invested in hardware and talent. As one commenter on Hacker News pointed out, "Anthropic does a somewhat similar thing. If you visit their ToS (the one for Max/Pro plans) from a European IP address, they replace one section with this: Non-commercial use only. You agree not to use our Services for any commercial or business purposes and we (and our Providers) have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity." Given how Microsoft positions Copilot as a powerful co-worker that you can entrust to help you get work done, seeing it referred to as 'for entertainment purposes only' is a stark reminder of how much these companies feel they need to cover themselves from the potential damage their AIs can do. More notably, Microsoft explicitly advises against relying on it for important decisions, warning: "Use Copilot at your own risk." This language stands out against the company's broader messaging. Such events highlight the persistent gap between promise and operational risk. The gap between the marketing and the fine print has drawn fresh scrutiny as adoption figures reveal that fewer than one in 30 eligible users is actually paying for the tool. Somewhere between Satya Nadella's earnings calls and the product pages promising to "transform the way you work," Microsoft inserted a sentence into Copilot's Terms of Use that reads rather differently from the rest of its AI pitch. Updated in October 2025 and surfacing widely in early April 2026, the clause appears under a section in bold capital letters labelled "IMPORTANT DISCLOSURES & WARNINGS." It says: "Copilot is for entertainment purposes only. It can make mistakes, and it may not work as intended. Don't rely on Copilot for important advice. Use Copilot at your own risk." The same document states that Microsoft makes no warranty or representation of any kind about Copilot, that users should not assume its outputs are free from copyright, trademark, or privacy rights infringement, and that users are solely responsible for any Copilot content they choose to share or publish. The terms apply to consumer Copilot products; the enterprise-facing Microsoft 365 Copilot is excluded from the clause. The disclaimer sits in sharp contrast to years of aggressive promotion. Since integrating Copilot across Windows 11 and the Microsoft 365 suite in 2023, the company has positioned the tool as a productivity multiplier, its "AI companion" for workers in Word, Excel, PowerPoint, and Outlook. Nadella has described Copilot as "becoming a true daily habit" and told investors that daily active users had grown nearly threefold year on year. The company spent approximately $80 billion on AI-related capital expenditure in fiscal year 2025, including a $13 billion investment in OpenAI whose models underpin Copilot's core capabilities. Microsoft 365 Copilot is priced at $30 per user per month as an enterprise add-on, with a business tier at $18 per user per month. Premium consumer tiers carry costs that reach into the tens of dollars monthly. "Entertainment purposes only" is not language typically associated with a product charging at those rates. Legal analysts who reviewed the language offered a measured interpretation. The most widely cited read is that the clause represents a lawyer's attempt to limit liability in circumstances where the product fails, an overcorrection that has become embarrassing because of how bluntly it contradicts the marketing. OpenAI, Google, and Anthropic all include similar advisories in their terms of service, acknowledging inaccuracy and placing responsibility for verifying outputs on users. None of them, however, uses the phrase "entertainment purposes only," which Android Authority noted is "the same disclaimer that a psychic uses to avoid getting sued." The broader legal context matters. Microsoft has faced litigation over Copilot's outputs before: a class-action suit in a US federal court in San Francisco challenged the legality of GitHub Copilot over alleged open-source licence violations, and a separate dispute in Australia concerned customers who were moved to more expensive plans with Copilot bundled in. The consumer Copilot ToS language, on this reading, is corporate defensiveness made explicit, an attempt to establish in writing that the product never warranted the reliance users might have placed on it. The disclaimer arrives at an awkward moment for Copilot's commercial trajectory. Data published in early 2026 showed that only 3.3% of Microsoft 365 and Office 365 users who have access to Copilot Chat actually pay for it. Of roughly 450 million Microsoft 365 seats, 15 million are paid Copilot subscribers, a conversion rate that reflects the difficulty of persuading existing users to pay a significant premium for AI they find unreliable. Research from Recon Analytics traced the problem in part to accuracy. Its tracking of Copilot's accuracy Net Promoter Score found it at -3.5 in July 2025, deteriorating to -24.1 by September 2025, and only partially recovering to -19.8 by January 2026. In surveys of lapsed Copilot users, 44.2% cited distrust of answers as the primary reason they had stopped using the tool. Separately, the US paid subscriber market share fell from 18.8% in July 2025 to 11.5% in January 2026, a 39% contraction in six months. When users are given a choice between Copilot, ChatGPT, and Gemini, just 8% of workers opt for Copilot. The hallucination record has not helped. In August 2024, Copilot falsely accused German court reporter Martin Bernklau of the crimes he had covered for years, describing him as a convicted child abuser and fraudster and providing his home address. Microsoft was forced to block queries about Bernklau after a data protection complaint. In January 2026, Copilot generated false claims about football-related violence, triggering further coverage of the tool's reliability problem. The "entertainment purposes only" clause looks rather less like a legal technicality in that context, and rather more like an accurate description. Nadella's response to Copilot's uneven performance has been to assume direct control over AI product development, reportedly delegating other responsibilities from September 2025 onward to focus personally on the roadmap. The company has also begun building its own models. Microsoft's launch of MAI-Transcribe-1, MAI-Voice-1, and MAI-Image-2 in April 2026 , its first proprietary AI model releases since renegotiating its contract with OpenAI in September 2025 -- signals a strategic intent to reduce dependency on the models that currently sit under Copilot's hood. The irony is that Copilot's limitations are well understood inside Microsoft. The company's own leaked internal feedback, as reported by several outlets, described integrations that "don't really work." The ToS language is, in a sense, the legal department's way of saying what the product team has been grappling with in private. The expectation that AI tools be trustworthy, verifiable, and fit for purpose has moved from aspiration to regulatory reality across multiple jurisdictions, making the gap between Copilot's marketing and its terms of service harder to sustain. None of this means Copilot is uniquely unreliable by the standards of the current generation of AI assistants. Its primary competitor, ChatGPT, has its own well-documented accuracy problems even as OpenAI pushes into commercialisation. The difference is that Microsoft bet earlier, louder, and more money on the proposition that AI assistants were ready to become essential workplace tools. The fine print in its own terms of service suggests the company is hedging on that bet while the marketing continues to double down on it. Competitors raising billions on promises of AI reliability will have noticed the opening. The race that defined 2025 is entering a phase where the gap between "for entertainment purposes only" and genuinely trustworthy AI is the most valuable real estate in the industry.

Over the past couple years, many of us have gotten pretty good at this, and have leaned to make the most of the many limitations we experience with so many AI agents. While the companies behind these projects are similarly aware of the limitations we're up against, one of them seems to be overcompensating a bit in the legal department, as Copilot users notice some concerning language in Microsoft's terms of service.

Sure, that's the kind of language you'll find in disclaimers across most AI tools, but Microsoft sure isn't treating Copilot as just for "entertainment." In a comment to PCMag, a Microsoft spokesperson said: "The 'entertainment purposes' phrasing is legacy language from when Copilot originally launched as a search companion service in Bing." They also added: "As the product has evolved, that language is no longer reflective of how Copilot is used today and will be altered with our next update." That said, even Microsoft is starting to realize that maybe they've put all their eggs in the wrong basket. The company recently said it's rethinking its AI ambitions and it'll scale back Copilot in Windows 11. Perhaps not the worst move, considering how poorly Copilot has been received by the public -- we even think Copilot is the new Internet Explorer.

So: use it to brainstorm, sure. But think twice before using it as a therapist.

Though the company very much wants businesses and employees to continue using Copilot for work, there's a clear shift in responsibility to the user here, clearing Microsoft of any accusations of false information. Microsoft says "use Copilot at your own risk" In a roundabout way, Microsoft is effectively admitting to the risk of AI hallucination amid ongoing concerns about copyrighted content, IP ambiguity and output legitimacy. With this in mind, the company clearly wants us to think of Copilot as a tool, not a decision-maker, and for users to independently fact-check outputs and be cautious with any sensitive, protected data. "You agree to indemnify us and hold us harmless... from and against any claims, losses, and expenses... arising from or relating to your use of Copilot," Microsoft added in another paragraph. More broadly, the company also notes that prompts and responses may be used to improve Copilot, however enterprise versions have additional protections to safeguard sensitive information. In other words, users retain the rights to their inputs, however Microsoft still has the right to use the data for improving the service. However, while Microsoft's efforts to push some responsibility onto the users' shoulders has hit the spotlights, it's not the only company with such terms. OpenAI, Google and Anthropic all state similar advisories in their terms, including user responsibility and no guarantee of accuracy. The shift in responsibility from AI vendor to user is an ongoing change that companies are asserting as the industry still works out what the legal risks could be, but with Microsoft still selling Copilot tools to business users and consumers, it's clearly a term rewording exercise than a total shift in behavior.
